Bruce A. Goldstein filed a lawsuit in Buffalo’s federal court naming Governor Andrew Cuomo and Kerry Delaney (Acting Commissioner of the NYS Office for People With Developmental Disabilities) as defendants.

The lawsuit alleges that Governor Cuomo and Commissioner Delaney have violated their obligations under the Americans With Disabilities Act which requires the state to provide a sufficient number of appropriate community residential facilities for the plaintiffs.
According to the lawsuit, many adults with disabilities are only placed in group homes after their parents die or become too ill to take care of them, which is disruptive and upsetting to the disabled individual who has just lost his or her parents.
The lawsuit seeks to persuade the state to authorize and regulate more residential openings. Depending on the particular individual’s abilities and needs, additional housing alternatives should range from group homes to supported apartments or another appropriate residential configuration.
